How We Use Your Data

1. Introduction

This document ("How We Use Your Data") is issued by Sakhi Safety AI Technologies (OPC) Private Limited ("Sakhi", "the Company", "we", "us" or "our") and forms part of the suite of user documents governing the Sakhi website, mobile application, wearable safety device and associated services (collectively, the "Platform").

This document is intended to be read together with the Sakhi Privacy Policy, Terms of Use, User Consent and Acknowledgement Form, Grievance Redressal Policy and Safety Policy. In the event of any conflict or inconsistency between this document and the Privacy Policy, the Privacy Policy shall prevail.

The purpose of this document is to provide, in a consolidated and focused manner, a description of how Sakhi uses the Personal Data collected from You, and to help You understand which of Your data enables which feature of the Platform.

The Platform is intended for individuals located in India and aged eighteen (18) years or above. The Platform is designed as a preventive personal safety solution and is not intended to replace emergency services, law enforcement, medical assistance or professional advice.

For the purpose of this document, "You", "Your" and "User" shall mean any individual accessing or using the Platform, including Protectors, and "Personal Data" shall have the meaning assigned under applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (collectively, "the said Acts").

2. Overarching Principles Governing Our Use of Your Data

Sakhi processes Your Personal Data only for legitimate purposes connected with providing, securing, improving and maintaining the Platform and its safety-related services.

Sakhi processes only such Personal Data as is necessary for the purposes described in this document, and only for such duration as is necessary to fulfil those purposes, subject to legal retention requirements.

Sakhi does not use Your Personal Data for any purpose that is materially different from those described in this document without Your consent, unless permitted or required under applicable law.

Sakhi does not sell, rent, lease, trade or otherwise commercially exploit Your Personal Data. Sakhi does not use Your Personal Data to display third-party advertising to You.

Sakhi does not use Your SOS event details, location history, Protector information, recordings or other safety-related information for advertising, or for training third-party artificial intelligence or large language models.

3. Use of Account and Registration Information

Sakhi uses Your account and registration information, including Your name, mobile number, email address, login credentials, profile information, account preferences and communication preferences, for the following purposes:

  • To register and authenticate You when You create an account and every time You access the Platform;
  • To generate and verify one-time passwords (OTPs) required for secure access;
  • To personalise the Platform experience based on Your profile and preferences;
  • To communicate with You in relation to Your account, safety features, alerts and Platform operations;
  • To provide customer support and respond to Your queries;
  • To confirm and record Your acceptance of the applicable Terms of Use, Privacy Policy and User Consent and Acknowledgement Form;
  • To confirm and record Your representation that You are eighteen (18) years of age or above.

4. Use of Location Information

Sakhi uses Your location information as a core component of its safety services, and only where You have granted the requisite location permissions on Your device.

Your location information is used for the following purposes:

  • To enable SOS alerts to be sent to Your Protectors, the Sakhi Response Hub, emergency service providers and Nearby Sakhi Users with an accurate reflection of Your position;
  • To share Your live and/or precise location with Your Protectors when You elect to do so, for the duration selected by You;
  • To generate the Safety Grid System, Safety Intelligence and location-based risk indicators shown to You on the Platform;
  • To provide route-related assistance, safest-route suggestions, safety insights and preventive safety information;
  • To identify the closest safety spots, including police stations, hospitals, fire stations and other locations that may be relevant in a safety situation;
  • To recognise Your routine patterns, based on the locations You designate as Home, Work, Hangouts and Commute under My World, so that Sakhi can detect and respond to deviations from Your routine;
  • To generate personalised Smart Safety Check-ins that consider factors including time of day, weather, area risk and Your routine.

Location information may be processed in aggregated, anonymised or de-identified form for the purpose of improving Sakhi's Safety Grid System, Safety Intelligence and risk analysis mechanisms, in a manner that does not identify You individually.

5. Use of SOS and Safety Event Information

When You activate SOS features through the App or the Sakhi Wearable Device, Sakhi uses the information associated with such event, including account information, the time and date of activation, location information, alert status, Protector details, communication records and verification information, for the following purposes:

  • To route the alert through the appropriate response pathway depending on the SOS trigger selected by You;
  • To notify Your Protectors of the alert and share the relevant location and situational information;
  • To route double-press SOS alerts through the Sakhi Response Hub for verification prior to further escalation;
  • To alert emergency service providers, including the police, on verified escalation;
  • To alert Nearby Sakhi Users within the applicable radius on verified escalation;
  • To share Your continuous live location with Your Protectors for a period of twenty-four (24) hours following a double-press SOS;
  • To capture, store and make available audio and video recordings taken during an SOS event, so that a record of the event is preserved for verification, dispute resolution and safety improvement purposes;
  • To maintain records of Your safety events for legal, regulatory, safety and audit purposes;
  • To detect and prevent misuse of the SOS feature.

Sakhi does not use SOS and safety event information for advertising, marketing or any purpose not directly connected to the provision of safety services or compliance with applicable law.

6. Use of Protector Information

Sakhi uses the information provided by You in respect of Your Protectors, including Protector name, mobile number, contact information, account-related information, invite code and OTP verification information, communication preferences and records of communications and alerts, for the following purposes:

  • To communicate with Your Protectors on Your behalf, in the manner set out in Your Alert Preferences;
  • To send Your Protectors safety alerts, SOS notifications, check-in nudges, live location updates and status information;
  • To enable Your Protectors to view, through the App, such safety information about You as You choose to share with them;
  • To verify Your Protector's identity through OTP-based verification;
  • To manage the invitation, acceptance, removal and replacement of Protectors on Your Sakhi account;
  • To maintain records of communications and alerts exchanged in connection with Your safety.

Where the User is themselves a Protector, Sakhi uses the information collected in that capacity solely for the purpose of enabling Protector features, including receiving alerts, initiating calls to the end user, and viewing information shared by the end user through the App.

7. Use of Sakhi Wearable Device Information

Sakhi uses information relating to the Sakhi Wearable Device paired with Your account, including device identification information, pairing information, connectivity status, battery status and technical performance data, for the following purposes:

  • To pair, authenticate and maintain the connection between the Device and Your mobile device;
  • To transmit safety alerts triggered from the Device to the Platform;
  • To display the current battery status of the Device within the App and, where applicable, to notify You when a replacement is due;
  • To enable You to locate the Device through the Find device feature by making it beep;
  • To monitor Device performance and reliability, and to provide technical support;
  • To improve the design, performance and safety features of future versions of the Device.

8. Use of Communications and Recordings

Sakhi uses communication and recording information, including SMS messages sent on Your instruction to Your Protectors, the police and Nearby Sakhi Users; audio and video recordings initiated by You through the Record feature or automatically initiated during a double-press SOS; voice interactions during the SOS Confirmation call and any speech-to-text transcription of those interactions; and Your communications with Our support team, for the following purposes:

  • To deliver alert messages to the intended recipients through SMS, in-App notification and, where required, automated voice call;
  • To preserve audio and video evidence of a safety event so that You have access to a record of what happened;
  • To transcribe voice interactions during the SOS Confirmation call for the purpose of automated verification of the SOS;
  • To respond to Your customer support queries and to keep an internal record of such communications;
  • To identify and remediate any technical issues with the delivery of safety communications.

Sakhi does not continuously record, listen to or monitor ambient audio. Audio and video recording is only initiated in connection with a specific safety event or by Your direct instruction.

9. Use of Community Feedback (Area Ratings)

Sakhi uses area safety ratings and feedback submitted by You through the Rate an area feature for the following purposes:

  • To aggregate community feedback into Sakhi's Safety Intelligence, so that risk indicators shown to all Users become more accurate over time;
  • To identify emerging or changing patterns in area safety;
  • To improve the utility of the Safety Grid System and safety-related notifications for all Users.

Aggregated community feedback is processed in a manner that does not identify You individually as the source of any specific rating.

10. Use of Payment Information

Sakhi uses payment-related information, including Your name, registered mobile number and email address, transaction details, subscription details, order details, payment status and billing information, for the following purposes:

  • To process Your purchase of the Sakhi Wearable Device;
  • To process Your subscription to Sakhi Pro;
  • To manage subscription renewals, upgrades, downgrades, cancellations and refunds;
  • To generate invoices, receipts and other transaction-related documents;
  • To respond to billing queries and disputes;
  • To comply with applicable tax, accounting and financial reporting obligations.

Complete payment instrument details, including card numbers, CVV details, UPI credentials and banking passwords, are handled by third-party payment gateway providers integrated with the Platform, and are not stored on Sakhi's servers. Sakhi's use of payment information is limited to transactional and account-related metadata.

11. Use of Usage, Diagnostic and Log Information

Sakhi uses information relating to Your interaction with the Platform, including feature usage, application performance data, error logs, technical activity records, device model, operating system, application version, IP address, device identifiers, network information and security-related information, for the following purposes:

  • To maintain the Platform in operational condition;
  • To detect, diagnose and remediate bugs, errors and performance issues;
  • To improve the reliability, performance and security of the Platform and its safety features;
  • To detect and prevent unauthorised access, misuse, fraud and security incidents;
  • To develop and test new features.

12. Use for Personalisation and Smart Safety Check-ins

Sakhi uses Personal Data, including location information, My World information, routine patterns, time-of-day information and general contextual signals available on the device, to personalise Your safety experience and to generate Smart Safety Check-ins, which are personalised contextual prompts sent to You when Sakhi assesses that a check-in adds material value to Your safety.

Sakhi does not use such personalisation to make legal or similarly significant decisions about You without a human review process, and does not use it to profile You for advertising or marketing purposes.

You may adjust or opt out of Smart Safety Check-ins at any time through the App.

13. Use of Artificial Intelligence and Automated Processing

Sakhi uses artificial intelligence, machine learning models, automated systems and data analysis technologies to enhance safety features on the Platform. Personal Data may be processed by such technologies for purposes including:

  • Generating Safety Intelligence, risk indicators and route suggestions;
  • Personalising the App experience;
  • Detecting abnormal activity or deviations from Your routine;
  • Powering the Sakhi AI safety companion and chat assistant;
  • Improving Platform reliability and safety outcomes.

Sakhi does not use Your Personal Data to train third-party large language models or artificial intelligence services outside Sakhi's control.

Where Sakhi's AI-generated output is used to escalate a safety situation to emergency services, a human review step is involved before such escalation, so that no purely automated decision produces a legal or similarly significant effect on You.

14. Sharing Consequent to Use

Sakhi shares Your Personal Data only to the extent necessary to give effect to the uses described in this document, and only with the following categories of recipients:

  • Your Protectors, in the manner You have chosen through Your Alert Preferences;
  • The Sakhi Response Hub, for verification and coordination of SOS events;
  • Emergency service providers, including the police, on verified escalation of a double-press SOS;
  • Nearby Sakhi Users, within the applicable radius, on verified escalation of a double-press SOS;
  • Third-party service providers who process data on Sakhi's behalf under contractual data protection commitments, including Our payment gateway provider, SMS delivery provider, speech-to-text provider, cloud infrastructure provider and logistics provider;
  • Legal, regulatory and government authorities, where required under applicable law or to protect the rights, safety or property of any person.

The details of Sakhi's sharing practices are set out more particularly in the Sakhi Privacy Policy.

15. Retention Linked to Use

Sakhi retains Your Personal Data only for the duration necessary to give effect to the uses described in this document, or for such longer period as is required under applicable law.

The indicative retention periods applicable to different categories of Personal Data are set out in the Sakhi Privacy Policy. The retention period applicable to each category is aligned with the purpose for which the relevant data is used.

16. Uses We Do Not Engage In

For the avoidance of doubt, Sakhi does not:

  • Sell, rent, lease, trade or otherwise commercially transfer Your Personal Data;
  • Use Your Personal Data to display third-party advertising to You;
  • Use Your SOS event details, location history, recordings, Protector information or other safety data to train third-party artificial intelligence or large language models;
  • Access Your recordings, location or other sensitive Personal Data other than as necessary to deliver a safety feature, respond to a grievance, or comply with applicable law;
  • Continuously record, listen to or monitor ambient audio, Your camera feed or Your device outside of a Platform-initiated safety event;
  • Use Your data for any purpose that is materially different from those described in this document without Your consent.

17. Your Rights and Choices

Subject to applicable law, including the Digital Personal Data Protection Act, 2023, You have rights in relation to Your Personal Data, including the rights of access, correction, erasure, withdrawal of consent, nomination and grievance redressal.

You may exercise Your rights or raise any query or grievance by contacting the Grievance Officer at the address set out in Clause 19 below.

You may withdraw consent for the processing of Personal Data at any time. Withdrawal of consent may limit or end Your ability to use certain features of the Platform.

You may delete Your Sakhi account at any time by submitting a deletion request at helpsakhi.com/delete-account. On receipt of a valid deletion request, Sakhi shall take reasonable steps to delete or anonymise Personal Data that is no longer required to be retained, subject to a thirty (30) day cooling-off period and to legal retention requirements.

18. Changes to This Document

Sakhi may modify or update this document from time to time to reflect changes in Platform features, technological developments, regulatory requirements or operational changes.

The updated document shall be published on the Platform with the revised effective date.

Your continued use of the Platform after such updates shall constitute acknowledgement of the revised document.
