1. Introduction

1.1. These Terms of Use ("Terms" or "these Terms") govern the user's access to and use of the Sakhi website, mobile application, wearable device and related safety services provided by Sakhi Safety AI Technologies (OPC) Private Limited ("Sakhi", "Company", "we", "us" or "our").

1.2. The website, mobile application, Sakhi Wearable Device, safety tools, communication features, location-based services and all related services shall collectively be referred to as the "Platform".

1.3. The Platform has been developed as a preventive personal safety solution designed to assist users through safety alerts, emergency communication, location-sharing features, safety insights, risk indicators, AI-assisted tools and wearable device integration.

1.4. For the purpose of these Terms, "You", "Your" and "User" shall mean any individual accessing or using the Platform, including Protectors (more particularly described further in these Terms).

1.5. By accessing, registering, installing, using or otherwise interacting with the Platform, You agree that You have read, understood and accepted these Terms. If You do not agree with these Terms, You shall not access or use the Platform.

1.6. The Sakhi Platform is intended for users located in India. It is not directed at, or designed for, individuals located in any other countries unless explicitly mentioned. We do not knowingly offer the services of the Platform to such other individuals.

1.7. These Terms are to be read together with Sakhi's Privacy Policy and any other policies, notices, guidelines or documents made available on the Platform and updated by Sakhi from time to time. These Terms govern Your access to, and use of, the Platform.

1.8. The Platform operates through electronic records and digital communication and is governed by applicable Indian laws including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, and other applicable laws and regulations (the "Acts" or "the said Acts").

2. Nature of the Platform

2.1. Sakhi is a preventive personal safety platform designed to assist Users through technology-enabled safety awareness, SOS communication, location-based insights, trusted contact networks and related safety features.

2.2. The Platform consists of:

  • The Sakhi mobile application;
  • The Sakhi Wearable Device, which enables Users to trigger an SOS through a connected Bluetooth-enabled device; and
  • The Sakhi safety response network, which may include Protectors, nearby Sakhi users, emergency service providers and other support mechanisms depending on the User's actions and selected settings.

2.3. You acknowledge that Sakhi is a technology platform intended to assist Users in accessing safety-related information and communication features. You acknowledge that no application, website, wearable device or technology-based service can guarantee prevention of crime, personal harm, injury, loss or any adverse event.

2.4. Sakhi does not guarantee that any safety feature, alert, communication, escalation mechanism or emergency response will prevent crime, harm, injury or ensure successful intervention. Sakhi does not function as a police authority, emergency response agency, medical service provider or law enforcement organisation.

2.5. The Platform is intended to support personal safety awareness and response capabilities. The Platform is not a replacement for police services, emergency responders, medical assistance or any other government or professional emergency service.

2.6. If You believe You are in immediate danger or require urgent assistance, You should directly contact the appropriate emergency authority, including 112 or any other applicable emergency number in India.

3. Acceptance of Terms

3.1. By accessing, downloading, registering on, purchasing from, or otherwise using the Platform, the User agrees to be bound by these Terms, the Privacy Policy and all other allied policies, notices and guidelines issued by Sakhi from time to time.

3.2. Sakhi reserves the right to update, modify and revise these Terms or other allied policies, notices and guidelines issued by Sakhi from time to time.

3.3. Your continued use of the Platform after any update, modification or revision of these Terms shall constitute acceptance of such revised Terms.

3.4. Certain features of the Platform, including location-based services, SOS functionality, Protector features, Safety Grid System, wearable functionality and emergency communication features, may require additional permissions, consents or acknowledgements from You before activation. In case You do not allow or disable such permissions, consents and acknowledgements, the said features may not function or may function improperly.

3.5. If You do not agree with any part of these Terms, the Privacy Policy or any applicable Platform policy, You shall immediately discontinue Your use of the Platform and related services.

4. Important Safety Notice

4.1. The effectiveness of Sakhi depends on several external factors, including mobile network availability, internet connectivity, GPS accuracy, device battery, phone settings, Bluetooth connection, permissions granted on Your device, operating system restrictions and availability of third-party services.

4.2. Because these factors are outside Sakhi's complete control, there may be situations where:

  • An SOS alert is delayed, interrupted or not transmitted;
  • An alert is not received, viewed or acknowledged by the intended recipient;
  • Location information is inaccurate;
  • Certain features do not function properly;
  • Communication with Protectors, nearby Sakhi users or emergency services is interrupted;
  • The Wearable Device may not function due to device connectivity, battery, Bluetooth range, compatibility or technical limitations.

4.3. You understand and acknowledge that no technology-based safety system can guarantee immediate assistance, prevention of crime or an incident, successful transmission of alerts or a specific response outcome in every situation. Due to these factors, Sakhi does not guarantee that every alert will be transmitted immediately, received successfully, or result in assistance.

4.4. You acknowledge that the availability, operation and behaviour of certain safety features may differ across devices, operating systems and technical environments, including Android and Apple iOS devices, due to restrictions, security measures and limitations imposed by respective operating systems.

4.5. On certain Apple iOS devices, configurations or circumstances, completing an emergency SMS or call may require an additional manual confirmation step by You and may not be capable of being fully automated. Sakhi does not guarantee identical functionality, automation or response behaviour across all devices, operating systems or technical environments.

4.6. You acknowledge that safety features may operate differently across different devices, operating systems and technical environments.

4.7. You remain responsible for assessing Your circumstances, taking appropriate safety measures and contacting relevant emergency services where required during any emergency situation.

4.8. Sakhi does not assume responsibility for the actions, availability, response time or decisions of Protectors, nearby Sakhi Users, emergency services or any third-party responder.

5. User Roles on the Platform

5.1. The Platform supports different categories of Users, User roles and external participants, including:

  • End User: the individual using Sakhi for their own personal safety;
  • Protector: a trusted contact invited by an End User to receive safety alerts and shared information;
  • Nearby Sakhi User: another Sakhi User who may receive safety alerts based on proximity and available functionality;
  • Emergency Service Providers: external authorities such as police or emergency responders; and
  • Sakhi Support/Response Hub: where applicable, individuals or systems assisting with safety-related communication.

5.2. Access, permissions and information available to each category of participant shall depend upon the applicable Platform feature, User consent, settings enabled by the User and functionality of the Platform.

5.3. Protectors and nearby Sakhi Users are independent Users of the Platform and are not employees, agents, representatives or emergency responders of Sakhi. Sakhi does not create any relationship of employment, agency, partnership, representation or authority between Sakhi and any Protector, nearby Sakhi User, emergency service provider or third-party participant.

5.4. Sakhi does not supervise, control or guarantee the availability, conduct, response, actions or decisions of any Protector, nearby Sakhi User, emergency service provider or other third-party participant.

6. User Eligibility and Responsibility

6.1. The Sakhi Platform is intended for individuals who are eighteen (18) years of age or above. Sakhi does not knowingly permit persons below eighteen (18) years of age to create accounts or use safety services requiring personal data.

6.2. By creating an account, You confirm that You are eligible to use the Platform, and that the information provided by You is accurate, complete and belongs to You. You agree not to create an account using false information, another person's identity or details. In case You do, Sakhi will not be responsible for any consequences that might entail such fraudulence or misrepresentation.

6.3. You are responsible for keeping Your account information updated and ensuring that Your login details remain confidential.

6.4. Sakhi may suspend or terminate accounts where information provided by You is false, misleading, incomplete or provided for misuse of the Platform.

7. Registration, Verification and Security

7.1. The Platform may require account registration through mobile number, email, password, OTP verification and/or other verification methods implemented by Sakhi from time to time.

7.2. OTP verification is intended to verify control over the registered contact details and enable secure access to the Platform. Such verification does not constitute independent verification of identity or personal circumstances of the User.

7.3. You should never share Your password, OTP or account access information with another person, as unauthorised access may affect Your safety features and personal information. You are responsible for maintaining the confidentiality and security of Your account credentials, OTPs, passwords (where applicable), device access, Wearable pairing information and any other authentication details associated with Your account.

7.4. You shall not share Your OTP, password, account credentials, Wearable access details or authentication information with any other person, as unauthorised access may compromise Your account.

7.5. You must immediately inform Sakhi if You believe that:

  • Your account has been accessed without permission;
  • Your phone or Wearable Device has been lost or stolen;
  • Your login credentials have been compromised;
  • SOS alerts have been triggered without Your knowledge; and/or
  • Any unusual activity has occurred through Your account.

7.6. You shall be responsible for activity carried out through Your account where such activity occurs due to Your failure to protect Your credentials or device access. You shall not be responsible for unauthorised activity occurring after You have notified Sakhi of suspected compromise, subject to reasonable verification.

7.7. Upon receiving notification of a suspected security incident or unauthorised access, Sakhi shall take reasonable steps to assess, contain and address such incident in accordance with this Policy, applicable law and its internal security processes.

7.8. Where such incident constitutes a personal data breach requiring notification under the Digital Personal Data Protection Act, 2023 and applicable rules, Sakhi shall provide the required notifications to the affected Data Principal(s) and the Data Protection Board of India, as applicable.

7.9. Sakhi may take reasonable measures to secure Your account, including restricting access, suspending Your account, verifying identity or temporarily disabling the account where it reasonably believes there is misuse, security risk or violation of these Terms.

8. Permissions Required for Platform Functionality

8.1. To enable and operate certain safety-related features, Sakhi may request access to certain permissions, device features and information, including but not limited to:

  • Location co-ordinates access;
  • Microphone access;
  • Camera access;
  • Notifications;
  • SMS permissions;
  • Background app activity;
  • Lock screen SOS access;
  • Lock screen and shortcut access;
  • Bluetooth and nearby device access;
  • Phone call functionality;
  • Contacts access;
  • Device, network and diagnostic information access;
  • Wearable device status, connectivity and battery information.

8.2. Sakhi only collects Your device-based location coordinates where You have enabled location permissions or activated location-based safety features. Any other location-related information displayed or used through the Platform, including current location, GPS coordinates, precise and/or live location, location history generated during safety features and route-related information, may be derived or generated from such coordinates, third-party mapping services, publicly available information and Sakhi's proprietary analysis methods.

8.3. Microphone access shall be used only for specific safety scenarios disclosed by Sakhi, including escalated SOS situations, and shall not constitute continuous audio surveillance. Sakhi does not continuously record, listen to or monitor ambient audio. Any audio-related information, if collected during a safety event, is processed only for emergency verification, response assistance and related safety purposes.

8.4. You acknowledge that these permissions are required to enable specific safety features of the Platform. If You deny, restrict or revoke required permissions, certain features including SOS alerts, location sharing, wearable connectivity or emergency communication may not function properly.

8.5. Sakhi shall not be responsible for failure of any feature caused due to denied permissions, device restrictions or operating system limitations.

9. Protector

9.1. The Platform allows an End User to add trusted contacts as "Protectors" who may receive safety alerts, location information and other safety-related information shared through the Platform based on the User's actions, settings and applicable features. The Protector relationship has a few defining features:

  • A Protector joins by invitation only. They cannot watch over someone who has not invited them.
  • A Protector sees only what the End User shares with them through the app.
  • The same person can act as an End User for their own safety and as a Protector for someone else; the app lets them switch context (a switch control appears in the header).
  • A Protector may watch over a maximum of five (5) protected people.

9.2. A Protector may be added only through an invitation initiated by the User. Such Protector shall be required to accept the invitation and complete the OTP verification process prescribed by Sakhi before accessing Protector functionality.

9.3. OTP verification of a Protector is intended to confirm control over the registered mobile number and enable secure access. Such verification does not constitute independent verification of the Protector's identity, relationship with the User, background, suitability or availability.

9.4. A Protector may receive only such safety-related information as is shared through the Platform, including alerts or location information generated during applicable safety events. What would constitute such safety-related information has been more particularly described in Clause 10 hereinafter. A Protector shall not obtain access to the User's account, device, settings or personal information beyond the permissions granted by the User and the functionality enabled by Sakhi.

9.5. The End User shall be solely responsible for selecting, inviting, removing and managing Protectors and shall ensure that any person added as a Protector is aware that they may receive the End User's safety-related information.

9.6. The Protector functionality is intended only for safety assistance and communication purposes. It is not intended to enable surveillance, monitoring or tracking of another person. Sakhi does not supervise, control or guarantee the availability, willingness, response time or actions of any Protector.

9.7. Protectors are independent individuals and are not employees, representatives or emergency responders of Sakhi. Sakhi shall not be responsible for any delay, failure, refusal or nature of response by any Protector.

9.8. You may remove a Protector at any time through the procedure described on the Platform.

10. Information Accessible to the Protector

10.1. For the functionality of the App, a Protector might access the following information related to the end user:

  • Name;
  • Safety Status;
  • Latest Activity;
  • Live and/or precise location (when being shared by the End User);
  • SOS event summary or full log;
  • Monthly safety summary of the End User (a count of safe days, a breakdown across safe, medium and/or high, a day-by-day safety timeline for the current month, number of SOS events and risk-zone days).

10.2. Such information is accessible to the Protector to assess the status of the End User's safety, be sent safety notifications where needed and for Platform functionality. Sakhi does not permit the Protector to access all account and/or device information provided by the End User for the Platform's functionality. Only the information mentioned explicitly in Clause 10.1 is accessible to the Protector of an End User.

11. Protector Functionality During SOS Alert

11.1. When an End User activates an SOS through the Platform, the SOS alert may be communicated to the User's designated Protectors, through a Single Press SOS, along with relevant safety information, including the End User's live location, where location sharing is enabled and available.

11.2. When an End User triggers an SOS, whether by pressing the SOS button on the Sakhi Wearable Device or from within the Sakhi App, an audible beep is sounded on the Protectors' mobile phones through the Sakhi App, so that they are alerted clearly and promptly, even if their phone is on silent or set aside. A Protector may acknowledge or silence the beep from within the App.

11.3. The Protector interface may display safety-related indicators and information including:

  • A change in the End User's safety status indicator;
  • Live location information of the End User during an active SOS event;
  • SOS notifications and alerts through the Platform;
  • Audible beep or other notification features enabled by Sakhi; and
  • SOS history, event details and related information made available through the Platform.

11.4. Where internet connectivity is unavailable or limited, Sakhi may use alternative communication mechanisms, including SMS-based notifications, where available and technically feasible.

11.5. A Protector's ability to view, access or respond to an SOS alert does not create any obligation on the Protector to provide assistance, and Sakhi does not guarantee any specific response, action or outcome from a Protector.

11.6. SOS history and event information displayed to a Protector shall be limited to information shared through the Platform.

12. SOS Alert System

12.1. The SOS feature is designed to help You quickly communicate that You may need assistance. The Platform may provide SOS functionality through which You may initiate safety alerts using available methods, including single-press or double-press activation, depending upon the features enabled by You:

  • Single-Press SOS: Where You activate a single-press SOS, the Platform may initiate an alert to Your designated Protectors through available communication channels, including SMS and in-App notifications. A single-press SOS alert may share relevant safety information with Your Protectors, including Your location information and the time of activation, where such information is available and permissions have been enabled. A single-press SOS is intended to notify Your selected Protectors and does not automatically notify emergency services, police authorities, nearby Sakhi Users or other third parties unless such escalation is specifically enabled through Platform functionality.
  • Double-Press SOS: Where You activate a double-press SOS, the Platform may initiate an escalated safety alert sequence which may include:
    • Immediate notification to Your Protectors through available communication channels, including SMS and in-App notifications;
    • Sharing of Your location information at the time of alert activation and, where available, subsequent location updates for a limited duration to assist Your Protectors;
    • Routing of the alert to Sakhi's designated response or verification systems, where applicable, for processing and verification;
    • Where an SOS is verified and the feature is available, communication of relevant alerts to emergency service providers and nearby Sakhi Users through available channels.

12.2. However, activation of SOS does not guarantee that assistance will reach You, that emergency authorities will respond, or that any third party will take action. You acknowledge that emergency escalation, police communication, nearby Sakhi User notifications and other third-party alerts depend upon multiple factors including network availability, internet connectivity, device functionality, permissions, location availability, third-party systems and applicable technical limitations.

12.3. The verification process may involve automated systems and technology-based checks. Such verification is performed on a best-effort basis and may not always happen immediately or successfully.

12.4. You acknowledge that the availability, operation and behaviour of certain safety features may differ across devices, operating systems and technical environments, including Android and Apple iOS devices, due to restrictions, security measures and limitations imposed by respective operating systems.

12.5. On certain Apple iOS devices, configurations or circumstances, completing an emergency SMS or call may require an additional manual confirmation step by You and may not be capable of being fully automated. Sakhi does not guarantee identical functionality, automation or response behaviour across all devices, operating systems or technical environments.

12.6. The Sakhi Response Hub is a technology support system and does not provide physical rescue, emergency response or law enforcement services.

12.7. The SOS feature must only be used when You have a genuine safety concern. You must not activate SOS as a prank, experiment, joke or in a manner that may mislead Protectors, emergency authorities, Sakhi users or other persons. False SOS alerts may create unnecessary panic, waste emergency resources and may result in suspension/deletion of Your account or action under applicable law.

12.8. Sakhi does not guarantee that any Protector, nearby Sakhi User, emergency service provider or other third party will receive, acknowledge or respond to any SOS alert.

12.9. You acknowledge that SOS functionality is designed to assist communication and safety awareness and does not guarantee prevention of any crime, harm, injury, loss or adverse event.

12.10. You shall use SOS functionality responsibly and shall not intentionally trigger false, misleading or unauthorised SOS alerts.

13. Emergency Services and Third-Party Response

13.1. Sakhi may facilitate communication and transmission of safety alerts, location information and related notifications to the Protectors, nearby Sakhi Users, emergency service providers or other third parties based on the features activated by the User and the functionality available on the Platform.

13.2. You acknowledge that Sakhi acts only as a technology platform facilitating communication and does not operate, control, command or represent any Protector, nearby Sakhi User, police authority, emergency service provider, government authority or other third-party responder.

13.3. Sakhi does not guarantee:

  • That any alert, notification, location information or communication will be successfully transmitted or received;
  • That any Protector, nearby Sakhi User, emergency service provider or other third party will view, acknowledge or respond to an alert;
  • The response time, availability, adequacy or effectiveness of any assistance provided; or
  • Any particular outcome following activation of safety features.

13.4. Accordingly, Sakhi shall not be responsible for:

  • Delay or failure by emergency services;
  • Refusal or inability of any authority or person to respond;
  • Adequacy or nature of assistance provided;
  • Actions or omissions of any third party.

13.5. Nearby Sakhi Users are independent users of the Platform and are not employees, agents, representatives or emergency personnel of Sakhi. Sakhi does not verify, supervise or control the actions, availability, willingness or ability of nearby Sakhi Users. You acknowledge that nearby Sakhi Users may choose whether or not to respond to alerts and Sakhi shall not be responsible for their response or failure to respond.

13.6. Where alerts or communications depend on SMS, mobile networks, internet connectivity or third-party communication infrastructure, delivery may be delayed, interrupted or unsuccessful due to circumstances outside Sakhi's reasonable control.

14. Location-Based Features

14.1. The Platform provides location-based safety features which require access to Your device-based location co-ordinates where such permissions have been granted by You.

14.2. Location information may be used for the following purposes:

  • Providing location-based safety features and recommendations;
  • Enabling safety alerts and notifications;
  • Sharing location information with Protectors or other recipients in case of SOS alerts;
  • Providing Safety Grid insights and risk awareness information;
  • Displaying safety zones, relevant nearby locations and related information;
  • Assisting with route-related or location-based suggestions;
  • Enabling emergency communication and escalation features during SOS alerts;
  • Improving the functionality, reliability and effectiveness of the Platform;
  • Activation and delivery of SOS alerts;
  • Live location sharing during an active SOS or safety event; and
  • Safety Grid insights and risk awareness information.

14.3. Sakhi only collects Your device-based location coordinates where You have enabled location permissions or activated location-based safety features. Any other location-related information displayed or used through the Platform, including current location, GPS coordinates, precise and/or live location, location history generated during safety features and route-related information, may be derived or generated from such coordinates, third-party mapping services, publicly available information and Sakhi's proprietary analysis methods.

14.4. The frequency and accuracy of location updates may vary depending upon device capabilities, GPS availability, network conditions, indoor or outdoor environment, permissions granted, battery optimisation settings, operating system restrictions and third-party service availability.

14.5. You acknowledge that location-based features, including live location sharing, may not operate continuously, accurately or without interruption in every situation.

14.6. Location sharing with Protectors, nearby Sakhi Users, emergency service providers or the Sakhi Response Hub may occur only in accordance with the User settings and permissions enabled.

14.7. You acknowledge that location information is intended to assist safety awareness and communication and should not be treated as a guaranteed indication of safety, risk or emergency response availability.

14.8. Sakhi does not guarantee that the use of the Platform, Sakhi Wearable Device, safety features or any associated services will prevent, avoid or eliminate any crime, harm, injury, loss, threat or adverse incident. Sakhi shall not be responsible for any crime, harm, injury, loss, damage or incident that may occur before, during or after the use of the Platform's location-based safety features or allied safety features.

14.9. You remain responsible for assessing Your circumstances and taking appropriate action during any emergency or safety-related situation and should not rely solely on location-based features.

15. Safety Grid System and Safety Intelligence

15.1. Sakhi may provide location-based safety information through its Safety Grid System (the "Safety Grid") to assist Users in understanding general safety conditions, for increasing awareness and making informed decisions.

15.2. The Safety Grid is a user-facing representation generated through Sakhi's proprietary preventive safety risk intelligence system (the "Safety Intelligence Engine"). The Safety Intelligence Engine comprises Sakhi's proprietary methodologies, analytical frameworks, internal processes, assessment parameters, models, data interpretation methods and mechanisms used to generate safety-related insights and risk indicators.

15.3. The Safety Grid may represent geographical areas through a map-based grid system and may classify such areas into different safety categories:

  • Low-risk zones;
  • Medium-risk zones; or
  • High-risk zones, based on available safety-related information and analysis.

15.4. Safety Grid indicators may be generated using a combination of information sources, including government surveys, publicly available information, official sources, third-party information, local area signals, historical trends and Sakhi's proprietary analysis methods. The Safety Grid is a preventive awareness and risk-assessment tool intended to provide contextual safety information. It is not an emergency warning system, crime prediction system or guarantee of safety. A risk classification does not mean that any area is completely safe or unsafe and does not predict the occurrence, likelihood or non-occurrence of any crime, incident, harm or adverse event. A location marked as a low-risk zone does not mean that no safety concern exists, and a location marked as a high-risk zone does not mean that an incident will occur. The risk zones are indicative assessments intended to support Your personal awareness and decision-making.

15.5. Safety Grid classifications may change over time based on changes in available information, geographic conditions, updated inputs and Sakhi's analysis processes.

15.6. The Safety Grid does not constitute continuous surveillance, real-time monitoring or an assurance that Sakhi has knowledge of all events occurring within any particular area. Sakhi does not guarantee that Safety Grid information will always be accurate, complete, current, uninterrupted and/or suitable for every User's individual circumstances.

15.7. The underlying methodology, internal parameters, weighting systems, assessment criteria and proprietary processes forming part of the Safety Intelligence Engine constitute confidential and proprietary information of Sakhi and shall not be disclosed.

15.8. Users remain responsible for exercising independent judgment and taking appropriate precautions while relying on Safety Grid information.

16. AI-Based Safety Features and AI Companion

16.1. The Platform may use artificial intelligence, machine learning models, automated systems and data-driven technologies to provide certain safety-related features, including but not limited to safety insights, risk indicators, route suggestions, alerts, recommendations and other related information (the "Safety Intelligence").

16.2. Safety Intelligence is generated based on available data, technology and system parameters and is provided only for general awareness, assistance and informational purposes. Such information:

  • May not always be accurate, complete, current or applicable to every situation;
  • Does not constitute a prediction, guarantee or assurance of any future event, threat, incident or safety outcome;
  • Does not replace Your personal judgement, precautionary measures or decision-making;
  • Does not constitute professional, legal, medical, security or emergency advice; and
  • Shall not be relied upon as the sole basis for making decisions relating to Your safety or the safety of any other person.

16.3. The Sakhi app also includes an AI-powered safety companion and chat assistant. When You interact with these features, the content of Your messages and the relevant context (such as time of day and general location risk-zone) are processed to generate a response.

16.4. The Sakhi AI companion processes Your messages and contextual signals to provide safety guidance. Sakhi may also analyse Your routine movement patterns to build a personalised baseline, so that significant deviations can be flagged as a possible safety concern. This profiling is used only for Your safety. It does not by itself produce a legal or similarly significant decision about You, and a human reviewer is involved before any escalation to emergency services.

16.5. You acknowledge that AI-generated information is provided only as a supportive tool and may not always be accurate, may contain errors or limitations, does not predict future events, does not replace emergency services and does not constitute professional advice.

16.6. You acknowledge that artificial intelligence systems may have limitations, including errors, inaccuracies, delays or unexpected outputs, and Sakhi does not guarantee that any Safety Intelligence or AI-generated information provided through the Platform will identify all risks or prevent unsafe situations.

16.7. You remain solely responsible for evaluating circumstances, taking appropriate safety measures and contacting emergency services where required.

16.8. You shall not misuse, reproduce, extract, distribute, commercialise or use any Safety Intelligence generated through the Platform except for Your personal, non-commercial safety purposes.

17. Sakhi Wearable Device

17.1. The Sakhi Wearable Device (the "Device") is a small Bluetooth wearable that can raise an SOS alert without the user having to touch or reach their phone. Such wearable may be in the form of everyday objects, making it a discreet wearable that can be easily carried everywhere by the user.

17.2. The Device functions in connection with the Sakhi mobile application installed on the User's paired mobile device and relies on the Bluetooth connection between the Device and such mobile device to transmit safety alerts.

17.3. While the User may not be required to reach or operate the mobile phone at the time of triggering an SOS through the Device, the Device must remain within the effective Bluetooth transmission range of the paired mobile device for the alert to be successfully communicated. The effective range may vary depending on environmental conditions, physical obstructions, device compatibility, battery levels, Bluetooth functionality and other technical factors.

17.4. Under ideal open conditions, the approximate transmission range may extend up to 100 metres; however, Sakhi does not guarantee uninterrupted connectivity or successful transmission in every situation.

17.5. The Device is intended solely as a preventive safety tool and is not:

  • A surveillance, tracking or monitoring device intended for unauthorised observation of any person;
  • A medical device, and shall not be used for diagnosis, treatment or medical assistance; or
  • A law enforcement, security or emergency response device, and does not provide physical protection, rescue or direct emergency assistance.

17.6. The functioning of the Device depends upon various factors including battery availability, charging status, Bluetooth connectivity, pairing with a compatible device, internet connection, mobile network availability, device permissions, operating system compatibility and proper functioning of associated third-party services.

17.7. You acknowledge that the Device may not function or may experience delays in certain situations due to circumstances beyond Sakhi's reasonable control, including technical failures, connectivity issues, device limitations or external service interruptions.

17.8. Sakhi does not guarantee that the Device will successfully transmit alerts, share location information or operate without interruption in every emergency situation.

17.9. You are responsible for ensuring that the Device is appropriately charged, connected, maintained and used in accordance with the applicable instructions provided by Sakhi.

17.10. The Device shall not be used as a substitute for contacting emergency authorities or taking immediate personal safety measures where required.

18. User Responsibilities

18.1. You agree to use the Platform responsibly, lawfully and only for the intended purpose of enhancing personal safety and accessing Sakhi's services. You shall not:

  • Use the Platform to track, monitor, surveil, locate or obtain information about any person without their knowledge and lawful consent;
  • Access, attempt to access, or use another user's account, credentials, device, data or safety information without authorisation;
  • Interfere with, disrupt, damage, disable or attempt to compromise the security, integrity or functioning of the Platform, including its software, servers, networks or connected systems;
  • Introduce, transmit or attempt to introduce any virus, malware, spyware, malicious code or any other harmful component into the Platform;
  • Misuse, manipulate, disclose, publish, share or exploit any information obtained through the Platform, including personal data, location information or safety-related information;
  • Copy, extract, scrape, reproduce, distribute, sell, commercialise or use any safety intelligence, risk indicators, insights, technology, content or data generated through the Platform for any commercial or unauthorised purpose;
  • Trigger false, misleading or unnecessary SOS alerts, misuse emergency features, or engage in any activity that may waste emergency resources, create panic, or place other users, Protectors or emergency responders at risk; or
  • Use the Platform for any unlawful, fraudulent, abusive or prohibited purpose or in violation of any applicable law.

18.2. Any violation of this Clause or misuse of the Platform may result in suspension or termination of Your access to the Platform, removal of relevant content or data, and/or such other action as Sakhi may consider appropriate, including reporting such conduct to the relevant authorities where required or permitted under applicable law.

18.3. You acknowledge that any unauthorised use, interference or misuse of the Platform may attract civil, criminal or regulatory consequences under the applicable laws in force.

19. Product Offering and Subscription Policy

19.1. Sakhi may be accessed through either of the following models:

  • Purchase of the Sakhi Wearable Device together with access to the Sakhi App; or
  • Subscription-based access to the Sakhi App without purchase of the Sakhi Wearable Device.

19.2. Device + App Model: Users who purchase the Sakhi Wearable Device shall receive access to the Sakhi App and applicable safety services for a period of twelve (12) months from activation of the Device at no additional subscription charge. Upon expiry of the initial twelve (12) month period, continued access to the Sakhi App and applicable safety services shall require an active subscription through monthly, annual or other plans made available by Sakhi at the applicable rates communicated through the Platform.

19.3. App-Only Model: Users may access the Sakhi App without purchasing the Sakhi Wearable Device by subscribing to an App-only subscription plan. Subscription plans may be chargeable monthly, annually or in any other manner made available on the Platform, and subject to the plan selected by the User. Applicable subscription charges shall become payable immediately upon sign-up on the App.

19.4. Subscription plans, billing cycles, applicable fees and renewal terms shall be displayed through the Platform and may be revised by Sakhi from time to time in accordance with these Terms.

19.5. Subscriptions may be purchased, activated, renewed or managed through the Sakhi App or through such other channels as Sakhi may make available from time to time.

19.6. Unless otherwise specified, subscriptions shall automatically renew at the end of each applicable billing cycle using the payment method designated by You at the time of purchase or renewal.

19.7. You may cancel auto-renewal at any time through the Platform or by contacting Sakhi through the support channels made available by Sakhi. Cancellation shall take effect from the end of the then-current billing period unless otherwise specified.

19.8. Cancellation of a subscription shall not entitle You to a refund for any period already utilised or completed, except where otherwise required by applicable law or expressly provided by Sakhi.

19.9. Subscription access may be restricted, suspended or discontinued where payment is unsuccessful, overdue, disputed, reversed or where suspension or termination is otherwise permitted under these Terms.

20. Orders and Product Purchases

20.1. Where the Platform enables purchase of devices or subscriptions, including the Sakhi Wearable Device, submission of an order or purchase request does not automatically constitute acceptance of such order.

20.2. An order shall be considered accepted only upon confirmation by Sakhi, subject to product availability, successful payment processing, verification of applicable details and other applicable requirements described in these Terms.

20.3. Sakhi reserves the right to refuse, cancel, suspend or modify any order where reasonably required due to:

  • Incorrect, incomplete or inaccurate information provided by You;
  • Technical errors, pricing errors or Platform-related issues;
  • Product unavailability or operational limitations;
  • Payment failure, dispute or suspected fraudulent activity;
  • Misuse of the Platform or violation of these Terms; or
  • Legal, regulatory, security or other reasonable business considerations.

20.4. Where payment has been successfully processed for an order that is cancelled or cannot be fulfilled by Sakhi, Sakhi shall initiate an applicable refund in accordance with the refund terms mentioned hereinbelow.

20.5. You are responsible for ensuring that all order details, including contact information and delivery details, provided through the Platform are accurate and complete.

21. Payments and Transactions

21.1. Certain features, services, subscriptions, products or devices, including the Sakhi Wearable Device and other offerings made available through the Platform, may require payment of applicable fees, charges, subscriptions, taxes or other amounts as displayed on the Platform.

21.2. Prices, fees and charges displayed on the Platform are intended to provide current information. However, due to technical errors, system limitations, updates or other circumstances, pricing or product information may contain inaccuracies. Sakhi reserves the right to correct any pricing, product or service-related errors and may, subject to applicable law, refuse, cancel or modify any order, subscription or transaction placed based on incorrect pricing or information.

21.3. Payments made through the Platform shall be processed through Razorpay or such other third-party payment gateway or payment service provider as may be designated by Sakhi from time to time.

21.4. Subject to availability through the applicable payment gateway, accepted payment methods may include:

  • Unified Payments Interface (UPI) payment methods, including Google Pay, PhonePe, Paytm and other UPI-enabled applications;
  • Net banking services supported by the applicable payment gateway;
  • Credit cards and debit cards, including Mastercard, Visa, RuPay and other card networks supported by the applicable payment gateway; and
  • Such other payment methods as may be made available through the Platform from time to time.

21.5. By initiating any payment, You represent and warrant that:

  • You are authorised to use the selected payment method;
  • The payment information provided by You is accurate, complete and valid; and
  • The use of such payment method does not violate any applicable law, regulation or third-party terms.

21.6. Sakhi does not directly operate, control or manage Razorpay or any other third-party payment gateway or payment service provider, and shall not be responsible for any failure, delay, interruption, rejection, unauthorised activity or security issue attributable to such third-party payment providers.

21.7. Sakhi does not store complete credit card, debit card or bank account details on its own servers. Payment information is processed and handled by the applicable payment gateway provider in accordance with its own terms, privacy practices, security standards and applicable law.

21.8. Any billing, payment or transaction-related discrepancy should be reported to Sakhi within a reasonable period from the date of the transaction to enable appropriate review and assistance.

21.9. In case Sakhi is unable to fulfil any accepted order or service due to reasons including unavailability, technical issues or other circumstances beyond reasonable control, Sakhi may notify You and provide an applicable refund or alternative remedy in accordance with these Terms, other policies as available and updated on the Platform and/or applicable laws.

21.10. Completion of a payment transaction does not automatically create an obligation on Sakhi to provide any product, service or feature unless such transaction has been accepted and confirmed in accordance with these Terms.

22. Shipping and Delivery

22.1. Shipping and delivery provisions apply only to purchases of the Sakhi Wearable Device. App-only subscriptions and other digital services are activated electronically and do not require physical shipment.

22.2. Sakhi offers shipment of the Sakhi Wearable Device within India only. Availability of delivery to specific locations shall be subject to serviceability and logistics availability.

22.3. Orders for the Sakhi Wearable Device shall ordinarily be processed and dispatched after successful payment confirmation and verification of the order details. Standard delivery timelines are estimated to be approximately five (5) to seven (7) business days from the date of dispatch. Actual delivery timelines may vary depending upon the delivery location, logistics conditions and other relevant factors.

22.4. Product tracking information, including order details, shipment details and tracking links, may be provided through available communication channels including SMS, email, WhatsApp or other Platform-supported methods.

22.5. Delivery timelines displayed or communicated through the Platform are estimates only and are not guaranteed. Delivery may be delayed due to factors beyond Sakhi's reasonable control, including weather conditions, public holidays, transportation disruptions, regulatory restrictions, courier capacity limitations or other logistics-related circumstances.

22.6. Sakhi may use third-party logistics, courier and delivery service providers for shipment and delivery of products and shall not be responsible for delays, interruptions, failed deliveries or other delivery-related issues attributable to such third-party service providers or circumstances beyond Sakhi's reasonable control.

22.7. You are responsible for providing accurate and complete delivery, contact and recipient information. Sakhi shall not be responsible for delays, failed deliveries or additional costs arising from inaccurate, incomplete or incorrect information provided by You.

22.8. Ownership of the Sakhi Wearable Device shall transfer to You upon successful delivery and receipt of full payment for the applicable product, subject to these Terms.

23. Cancellation, Refund and Return Policy

23.1. The Sakhi Wearable Device is a personal-use safety product. Due to hygiene, personal use, safety and product integrity considerations, returns after delivery may be restricted and shall be accepted only in accordance with this Policy, applicable warranty terms and applicable law.

23.2. For the Sakhi Wearable Device:

  • A User may cancel an order for the Sakhi Wearable Device within twenty-four (24) hours of placing the order, provided that the Device has not been dispatched.
  • Where a valid cancellation request is received before dispatch, Sakhi shall initiate a refund of the amount paid to the original payment method. Refunds are ordinarily processed within seven (7) to ten (10) business days, subject to payment gateway, banking and other third-party processing timelines.
  • Once the Sakhi Wearable Device has been dispatched or delivered, cancellations, returns and refunds shall not be permitted except as expressly provided in these Terms or the applicable warranty provisions.
  • If the Sakhi Wearable Device is delivered with physical damage, missing components, manufacturing defects or is non-functional upon arrival, the User must notify Sakhi at support@helpsakhi.com within forty-eight (48) hours of delivery and provide reasonable details or evidence of the issue. Upon verification of a valid claim under this Clause, Sakhi may provide a replacement Device in accordance with the applicable warranty provisions.
  • Except as expressly provided herein, no refund shall be available after dispatch or delivery of the Sakhi Wearable Device.

23.3. For App Subscriptions:

  • Subscription-based access to the Sakhi App and related services may be cancelled at any time through the App, through the Platform, or by such other means as Sakhi may make available.
  • Cancellation of a subscription shall prevent future automatic renewals but shall not affect access to services already paid for during the then-current billing period.
  • No refund shall be issued for any unused portion of an active subscription period following cancellation.

23.4. Where a valid return request is accepted, Sakhi may, subject to its assessment of the issue:

  • Replace the product; or
  • Issue an applicable refund.

23.5. The replacement of the product shall take place in accordance with the terms of the Warranty Clause prescribed hereinbelow.

24. Warranty of Sakhi Wearable Device

24.1. The Sakhi Wearable Device is covered by a limited warranty for a period of twelve (12) months from the date of delivery. The warranty is provided through Sakhi's hardware vendor and is passed through to the End User in accordance with these Terms.

24.2. This warranty applies only to the Sakhi Wearable Device and does not apply to App-only subscriptions or any services for which no hardware is supplied.

24.3. Subject to the exclusions set out herein, the warranty covers defects in materials or functionality of the Sakhi Wearable Device arising during normal use of the product within the warranty period.

24.4. Where a valid warranty claim is accepted, Sakhi may, at its discretion and within a reasonable timeframe:

  • Repair the Sakhi Wearable Device; or
  • Replace the Sakhi Wearable Device with an equivalent replacement product.

24.5. Warranty Exclusions: The warranty does not cover:

  • Damage caused by accident, abuse, misuse, negligence or improper handling;
  • Damage caused by unauthorised repair, modification, alteration, tampering with or opening of the Device;
  • Battery exhaustion, normal battery degradation or reduction in battery performance resulting from ordinary use;
  • Water leakage, liquid ingress or damage caused by exposure beyond the Device's stated water and dust ingress rating or specifications;
  • Damage caused by natural disasters or force majeure events, including floods, fires, lightning, earthquakes or similar events;
  • Damage caused by connecting or using the Device with unsuitable, incompatible or unauthorised devices, accessories or charging equipment;
  • Normal wear and tear, cosmetic damage, scratches, dents or deterioration that does not materially affect the functionality of the Device;
  • Issues arising from mobile device compatibility, Bluetooth connectivity, operating system restrictions, network availability, GPS limitations or other external factors beyond the Device itself.

24.6. Warranty Claim Procedure: To submit a warranty claim, You must contact Sakhi at support@helpsakhi.com and provide:

  • Proof of purchase or order details;
  • A description of the issue or defect; and
  • Photographs, videos or other reasonable evidence of the reported defect where available.

24.7. Sakhi may require You to return the Device to an address designated by Sakhi, securely packaged and in accordance with any instructions provided by Sakhi.

24.8. Upon receipt of the Device, Sakhi or its authorised service provider may inspect and evaluate the reported issue to determine whether the claim qualifies for warranty coverage.

24.9. Following verification of a qualifying warranty claim, Sakhi may repair or replace the Device in accordance with this warranty.

24.10. The warranty applicable to the Sakhi Wearable Device does not constitute a guarantee that the Platform, SOS functionality, alerts, location services, emergency communications or any safety-related feature will operate without interruption or result in assistance, prevention of harm or emergency response.

24.11. Sakhi's liability under this warranty shall be limited to repair or replacement of the Sakhi Wearable Device in accordance with this Clause.

24.12. To the maximum extent permitted by law, Sakhi shall not be liable under this warranty for any indirect, incidental, special or consequential loss or damage, including loss of use, loss of profits, loss of business opportunity or loss of data.

24.13. Nothing in this warranty excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including rights available under the Consumer Protection Act, 2019.

24.14. This warranty shall remain valid only within India.

25. Intellectual Property Rights

25.1. All rights, title and interest in and to the Platform, including but not limited to software, source code, designs, interfaces, trademarks, logos, content, documentation, technology, Safety Grid System, Safety Intelligence Engine, Safety Intelligence, risk assessment methodologies, analytical frameworks, models, processes and other proprietary materials, belong exclusively to Sakhi or its licensors.

25.2. Subject to these Terms, Sakhi grants You a limited, non-exclusive, non-transferable, revocable right to access and use the Platform solely for personal safety purposes.

25.3. You shall not, without prior written permission from Sakhi:

  • Copy, modify, reproduce or distribute any part of the Platform;
  • Reverse engineer, decompile, disassemble or attempt to derive the source code or underlying technology;
  • Scrape, extract, collect or commercially use Platform data, safety intelligence, Safety Grid information or content;
  • Use the Platform or any part thereof for commercial exploitation or unauthorised purposes.

25.4. Any unauthorised access, reverse engineering, scraping, copying, interference, circumvention of security measures, misuse of the Platform, infringement of Sakhi's intellectual property rights, or other activity intended to undermine or adversely affect Sakhi or the Platform may result in suspension or termination of access and the initiation of appropriate civil, criminal or other legal proceedings by Sakhi.

26. Third-Party Services

26.1. The Platform may rely on third-party services including communication providers, mapping services, cloud infrastructure providers, communication platforms, payment gateways, app stores, analytics services and technology providers. Such services are outside Sakhi's control and may have their own terms and privacy policies.

26.2. The Platform may include or provide access to certain information, resources and materials such as safety articles, awareness content, helpline directories, educational material and other information contributed or provided by third parties, including partner organisations, non-profit entities, researchers, experts or other contributors.

26.3. Wherever reasonably practicable, Sakhi may identify the source of such third-party content. Such content is provided for general awareness, information and convenience purposes only. Sakhi does not endorse, verify, control or guarantee the views, opinions, recommendations, services or information provided by third-party contributors.

26.4. Sakhi does not represent or warrant that such third-party content is accurate, complete, current, reliable or suitable for Your individual circumstances. You acknowledge that third-party content does not constitute professional advice, emergency assistance, law enforcement support or a substitute for exercising Your own judgment.

26.5. You should independently verify any important information before relying upon such third-party content or taking any action based on it.

26.6. Sakhi does not control and shall not be responsible for the availability, accuracy, security, performance, interruption or failure of any third-party service.

26.7. Any delay, interruption or limitation caused by third-party services shall not be considered a failure of Sakhi's services.

27. Disclaimer of Warranties

27.1. You acknowledge that the Platform relies on technology, device functionality, battery availability, Bluetooth connectivity, GPS accuracy, mobile networks, internet connectivity, SMS services and other external systems and service providers, some of which are outside Sakhi's reasonable control. Sakhi does not represent, warrant or guarantee that the Platform, or any safety-related or other feature of the Platform, will always function without interruption, delay, error, failure or technical limitations.

27.2. Sakhi does not guarantee that:

  • The Platform, Sakhi Wearable Device or any associated feature will always be uninterrupted, error-free, secure or continuously available;
  • Alerts, notifications, SOS communications or other communications will always be delivered, received, acknowledged or acted upon;
  • Location information, Safety Grid information or other safety insights, recommendations or outputs will always be accurate, complete, current or suitable for every situation;
  • Emergency services, Protectors, nearby Sakhi Users or any third parties will respond, be available or provide assistance;
  • The Platform, Wearable Device or any safety feature will prevent, avoid or eliminate any crime, harm, injury, loss, threat or adverse event.

28. Limitation of Liability

28.1. To the maximum extent permitted by applicable law, Sakhi shall not be liable for any loss, damage, injury, harm, claim, expense or consequence arising from or relating to:

  • Delay, failure, interruption, non-delivery or unsuccessful delivery of alerts, notifications, SOS communications or other Platform communications;
  • Inaccurate, incomplete, unavailable, delayed or interrupted location information, live location sharing or location-based features;
  • Safety Grid classifications, safety insights, recommendations, risk indicators or other location-based information provided through the Platform;
  • Any crime, harm, injury, loss, threat or adverse event occurring before, during or after use of the Platform or any safety feature;
  • Actions, omissions, delay, refusal or failure to respond by Protectors, nearby Sakhi Users, emergency services, authorities or any third parties;
  • Failure, limitation or unavailability of the Sakhi Wearable Device, mobile device, Bluetooth connection, battery, GPS, internet connectivity, SMS services, telecom networks or third-party services;
  • Misuse of the Platform, incorrect use of safety features or failure to follow applicable instructions;
  • Unauthorised access, account compromise or security incidents arising due to User negligence, failure to protect credentials, device access or account information.

28.2. You acknowledge that the Platform is intended to assist with safety awareness, communication and access to safety-related features and does not guarantee prevention of any crime, incident or availability of assistance.

29. Indemnity

29.1. You agree to indemnify, defend and hold harmless Sakhi, its directors, officers, employees, affiliates, licensors, technology partners, service providers and representatives from and against any claims, demands, actions, losses, damages, liabilities, penalties, costs and expenses arising out of or relating to:

  • Your access to or misuse of the Platform, Sakhi Wearable Device or any associated services;
  • Your violation of these Terms, the Privacy Policy, other policies as and when added to or updated on the Platform, or any applicable law, regulation or requirement;
  • False, misleading, accidental, unauthorised or abusive activation of SOS alerts or safety features;
  • Misuse of location-based features, Safety Grid information, safety insights or any information provided through the Platform;
  • Sharing, disclosure or misuse of another person's information, location information or personal data without appropriate consent or authority;
  • Selection, addition, removal or interaction with Protectors, nearby Sakhi Users or any other third-party participants;
  • Any act, omission, communication or conduct carried out through Your account;
  • Violation of any third-party rights, including privacy rights, intellectual property rights or other legal rights;
  • Compromise of account security caused by Your failure to protect Your credentials, OTP, device access, wearable access or authentication information;
  • Unlawful, fraudulent or unauthorised activity conducted through Your account or using the Platform.

29.2. You acknowledge that certain Platform features involve communication or interaction with third parties, including Protectors, nearby Sakhi Users, emergency service providers and technology providers, and You shall be responsible for Your conduct and communications in connection with such interactions.

29.3. This indemnity shall survive termination or suspension of Your access to the Platform.

30. Suspension and Termination

30.1. Sakhi may suspend, restrict or terminate Your access to the Platform, account or any specific feature where Sakhi reasonably believes that:

  • You have violated these Terms, the Privacy Policy, other policies made available on the Platform or any applicable law;
  • Safety features, SOS functionality, Protector functionality or the Sakhi Wearable Device have been misused;
  • False, misleading, fraudulent or unauthorised alerts, notifications or communications have been initiated;
  • Unlawful, abusive or unauthorised activity has been conducted through Your account;
  • There is a security risk, unauthorised access, compromise of Platform integrity or threat to other Users;
  • You have attempted to reverse engineer, extract, scrape, copy or misuse Platform content, Safety Grid information, Safety Intelligence Engine or proprietary technology;
  • Your actions may adversely affect the operation, security or availability of the Platform or services.

30.2. Sakhi may take such action immediately where reasonably necessary to protect the Platform, its Users, third parties or the integrity of safety-related features.

30.3. Suspension or termination may result in restriction or loss of access to certain Platform features, including location sharing, SOS functionality, Protector-related features or associated services.

30.4. Termination shall not affect any rights, obligations or provisions which by their nature are intended to survive termination, including provisions relating to intellectual property rights, disclaimers, limitation of liability, indemnity, governing law and dispute resolution.

31. Changes to Terms

31.1. Sakhi may modify or update these Terms from time to time due to changes in technology, Platform functionality, applicable laws or business requirements.

31.2. Updated Terms shall be made available through the Platform or other appropriate communication methods, prescribed by Sakhi.

31.3. Continued use of the Platform after such updates shall constitute acceptance of the revised Terms.

32. Governing Law and Dispute Resolution

32.1. These Terms, the use of the Platform and any disputes arising out of or relating to the Platform shall be governed by and interpreted in accordance with the laws of India.

32.2. In the event of any dispute, disagreement, claim or controversy arising out of or in connection with these Terms, the Privacy Policy, or other policies updated on the Platform or any services provided by Sakhi, the Parties shall first attempt to resolve the matter through good-faith communication and discussion with Sakhi.

32.3. If the dispute cannot be resolved amicably within a reasonable period, such dispute shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended from time to time).

32.4. The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties. In the event the Parties fail to mutually agree on the appointment of an arbitrator, the appointment shall be made in accordance with applicable provisions of the Arbitration and Conciliation Act, 1996.

32.5. The seat and venue of arbitration shall be Punjab, India and the arbitration proceedings shall be conducted in the English language. The arbitral award shall be final and binding upon the Parties.

32.6. Nothing in this clause shall restrict Sakhi from seeking urgent interim or injunctive relief from a court of competent jurisdiction for protection of its intellectual property, confidential information, Platform security or User safety.

32.7. Nothing contained herein shall limit or exclude any rights available to Users under applicable consumer protection laws.
